By accessing the SyncOne.net website ("Site") or using the services offered by SyncOne.net ("Services") you agree and acknowledge to be bound by these Terms of Service ("Terms"). 1. Usage License
SyncOne.net grants you a limited license to access the Site and use the Services in accordance with these Terms and the instructions and guidelines posted on the Site. Such license does not include, without limitation; any reproduction, duplication, resale or commercial use of the Service or content therein; or making derivative uses of the Service or content stored therein. You are not granted any rights or licenses except as expressly provided herein in or under any proprietary right of SyncOne.net or any third party. 2. User Responsibility

You agree NOT to use the Service (and it shall be a violation of these Terms of Service) to; Upload any Content in violation of any third party's rights to that Content; Upload any Content that is harmful, hateful, harassing, threatening, or abusive; that would violate another's rights or constitute or encourage a criminal offense; or that would otherwise violate any local, state, national or international law; Upload any Content or allow any Content to remain in your archives in a manner that exceeds the scope of your rights to use such Content (e.g. license rights associated with premium content or subscription-based materials) or which you do not have a right to Upload from the Content owner; Upload any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; Upload any Content that contains software viruses or any other computer code designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or perform functions on any computer without the computer owner's express consent; impersonate any person or entity, including, but not limited to, a SyncOne.net official or SyncOne.net staff member; interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service; violate any applicable local, state, national, or international laws; harass or "stalk" another individual; or collect or store personal data about other users, artificially generate traffic or page links to a web site or for any other purpose not intended for personal, noncommercial use, or authorize, aid, or encourage anyone to do anything in violation of this Terms of Service. In using the Service, you may access Content that is Uploaded to SyncOne.net by other users, such as information in SyncOne.net search results, and other parts of the Service. You may be exposed to Content that is inaccurate, offensive, indecent, or objectionable. Uploaded Content is the sole responsibility of the person who Uploaded it. SyncOne.net does not make any representations or warranties about the accuracy, integrity, quality or any other aspect of such Content and disclaims all liability for such Content for any loss or damage incurred as a result of the use of such Content. By using the Service, you agree to bear all risks associated with the use of any Content on the Service and any reliance on the accuracy, completeness, or usefulness of such Content. SyncOne.net does not pre-screen, edit or review any Content Uploaded to SyncOne.net. SyncOne.net has the right (but not the obligation) in its sole discretion, to remove, move, change from public to private, or otherwise restrict any Uploaded Content at any time, with or without notice.
3. User-Posted Content
By posting content, you are granting permission to us and others to access and use it in connection with the Services, the Site and otherwise in connection with our business. You can mark content as not public to restrict access and use to those users to whom you explicitly grant access. For publicly accessible content, you can label your compilations with one of several possible licenses. It is important to note that you can only copyright the compilation itself, not the individual links that make up the compilation. Please also note that just because your compilation does not have a license agreement attached to it does not mean that it is public domain. For a compilation to be classified as such, it must be explicitly labeled as belonging to the public domain. Your use of a license in connection with your compilation does not affect SyncOne.net's right to access and use it in connection with the Services, the Site or otherwise in connection with our business. SyncOne.net does not provide legal services, and therefore, providing you with the ability to attach a license agreement to your compilation of links does not create an attorney-client relationship. The license agreements and all related information are provided on an "as is" basis. SyncOne.net makes no warranties whatsoever regarding the license agreements and the information provided, and disclaims all liability for damages, including without limitation, any general, special, incidental or consequential damages, resulting from their use. SyncOne.net will include this license label in making your content accessible to others, but any enforcement of your chosen license terms remains your sole responsibility. SyncOne.net is explicitly not responsible for the manner or circumstances by which third parties access or use public content and is under no obligation to disable or otherwise restrict this access. SyncOne.net-originated content included on the Site, such as text, graphics, logos, data compilations, APIs, software and the compilation of all content on the Site, is the property of SyncOne.net and its licensors and protected by United States and international copyright laws. Except as set out in these Terms, no reproduction of any SyncOne.net-originated content is permitted without written permission from SyncOne.net. User-posted content is copyrighted, and any use or reproduction of user-posted content must comply with the terms of the respective license(s) and must include a label indicating such license.
5. Change to service
You agree that SyncOne.net has the right at any time to modify or discontinue the Service, or any portion of the Service, with or without notice. You further agree that SyncOne.net will not be liable to you or any third party due to the modification, discontinuance, or temporary suspension of the Service.
6. No Warranty and Limitation of Liability
SyncOne.net PROVIDES THE SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. SyncOne.net SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. You understand and agree that you use the Site and Services at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. 7. Other
SyncOne.net and you are independent entities, and nothing in the Terms, or via use of the Site or Services, will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between SyncOne.net and you. These Terms supersede any previous agreement and represent the entire agreement between SyncOne.net and you. If any provision of the Terms is adjudged to be illegal or unenforceable, the continuation in full force of the remainder of the Terms will not be prejudiced, and the illegal or unenforceable provision of the Terms shall be severed accordingly.
